SUMMARY:Mock Cross-Examination Skills Workshop: Mastering Expert Witness Examination in Arbitration
DESCRIPTION:Mock Cross-Examination Skills Workshop: Mastering Expert Witness Examination \nin Arbitration Join the American Arbitration Association®-International Centre for Dispute Resolution® (AAA-ICDR®)\, Young CalArb\, and IBA Arb40 for an immersive\, half-day legal skills workshop designed to strengthen advocacy in international arbitration. \nThis interactive program places participants in a realistic arbitration setting where they will conduct and observe the cross-examination of an expert witness in a fictional international commercial dispute. Working in teams under the guidance of experienced arbitrators\, counsel\, and expert witnesses\, participants will practice strategic questioning\, witness control\, impeachment techniques\, and effective use of expert evidence. Each mock hearing will conclude with a structured faculty debrief providing practical feedback on advocacy style\, examination strategy\, and persuasive techniques used during the simulation. \nUnlike traditional lecture-based programs\, this workshop emphasizes experiential learning through hands-on participation and direct observation. It is designed for junior and mid-level practitioners\, in-house counsel\, and arbitration professionals seeking to develop practical hearing skills applicable to international arbitration proceedings.

SUMMARY:How Far Is Too Far? The Arbitrator’s New Red Lines in International Arbitration: AI • Disclosure • Due Process • Case Management • Counsel Conduct
DESCRIPTION:Including Holiday Cocktail Reception \nInternational arbitration is evolving rapidly\, and with it\, the boundaries of the arbitrator’s role are being tested and redefined. How proactive can an arbitrator be before robust case management becomes overreach? How much disclosure is enough\, and when can disclosure itself create unnecessary challenges? What does due process require when efficiency and procedural economy are also at stake? How should tribunals respond to aggressive conduct by counsel? And perhaps most urgently\, where should the line be drawn on the use of artificial intelligence by arbitrators\, counsel\, experts\, and institutions?2 \nThis panel will explore the emerging “red lines” of international arbitration through practical scenarios and competing perspectives. Panelists will examine the difficult judgment calls arbitrators increasingly face: using AI in researching\, drafting\, or analyzing a case; determining what relationships or circumstances require disclosure; balancing procedural fairness against efficiency; intervening\, or choosing not to intervene\,in counsel conduct; and exercising procedural discretion without compromising neutrality or the enforceability of the award. \nRather than focusing only on what arbitrators can do\, the discussion will ask the more challenging question: how far should they go? Through real-world hypotheticals and audience engagement\, the panel will identify where accepted practice ends\, where legitimate discretion begins\, and where arbitrators may risk crossing the line. \nFollowing the panel\, we invite all attendees to join us for our Holiday Cocktail Reception\, a festive opportunity to continue the conversation\, connect with colleagues and friends from the international arbitration community\, and celebrate the holiday season together. \nModerated by: Yanett Quiroz \nSpeakers: Hon. Michael Massengale (Former) FCIArb\, Marcus Quintanilla FCIArb\, Ann Ryan Robertson C.Arb FCIArb FCollArb
